1. Acceptance of these Terms

These Terms of Use govern your access to and use of the Zomroll mobile application, website, and related services. By downloading, accessing, or using Zomroll, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. Eligibility and account responsibility

You may use Zomroll only if you are legally permitted to enter into a binding agreement under applicable law. If you use the app on behalf of another person or organization, you confirm that you have authority to do so.

You are responsible for activity that occurs through your device, Apple ID, subscription settings, and any permission state connected to your use of Zomroll. You agree to provide accurate information when contacting support or requesting assistance.

3. What Zomroll does

Zomroll is a digital wellbeing and screen-time support app. It provides screen-time insights, gamified progress tracking, focus-related tools, and optional app-limiting flows through Apple-provided system frameworks. Zomroll is not a medical device, therapy service, emergency tool, or professional health service.

4. Apple App Store terms

If you downloaded Zomroll from the Apple App Store, you acknowledge that these Terms are between you and Zomroll, not with Apple. Apple is not responsible for the app, its content, maintenance, support, warranty handling beyond any non-waivable obligation, or claims relating to the app except as required by law.

Your use of Zomroll must also comply with the App Store terms, Apple Media Services Terms and Conditions, and any applicable usage rules made available by Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent applicable to the licensed app relationship.

5. Limited license

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Zomroll for your personal, non-commercial use on devices you own or control, in accordance with Apple's usage rules and these Terms.

6. Acceptable use

  • You agree not to misuse, disrupt, reverse engineer, or interfere with the app or related systems.
  • You agree not to use Zomroll for unlawful, abusive, fraudulent, or harmful activity.
  • You agree not to attempt to bypass subscription controls, entitlement checks, or access restrictions.
  • You remain responsible for your own device settings, app restrictions, and Apple account controls.
  • You agree not to use automation, scraping, or unauthorized tools to copy or access non-public parts of the service.

7. Service availability, updates, and feature changes

We may release updates, patches, bug fixes, design changes, content adjustments, and feature changes at any time. Some functionality may depend on your operating system version, device capabilities, region, network access, or Apple's platform rules. We do not guarantee that every feature will be available in every country or on every device.

8. Permissions and device controls

Some Zomroll features depend on permissions you choose to grant, such as Screen Time, notifications, and Family Controls-related access where supported by Apple. If permissions are denied, revoked, or limited, certain features may not function as intended.

9. Subscriptions, trials, and billing

  • Certain features require an auto-renewable subscription that is purchased through your Apple ID account.
  • Available plan names, pricing, billing periods, and any free-trial offer are shown in-app at the time of purchase and may vary by country, currency, storefront, promotion, or tax treatment.
  • Payment is charged by Apple at confirmation of purchase, and subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
  • The exact renewal date, billing cycle, trial length, and storefront availability are determined by Apple and shown to you before purchase.
  • You can manage or cancel subscriptions in your Apple account settings. Apple handles billing, renewals, refunds, and payment processing subject to Apple's own terms and policies.
  • If you start a free trial and do not cancel before the trial ends, your subscription will convert into a paid subscription under the terms presented by Apple at checkout.

10. Pricing, taxes, and promotional offers

Subscription pricing may vary by country, currency, local taxes, platform pricing tiers, introductory offer, or temporary promotion. We may update feature packaging or plan presentation over time. Where required by applicable law or platform policy, price changes for renewals will be communicated through Apple or reflected in your subscription management flow.

11. Cancellations and refunds

You may cancel an auto-renewable subscription at any time in your Apple account settings. Cancellation stops future renewals but does not retroactively cancel any already-started billing period unless Apple provides otherwise. Refund requests, charge issues, and billing disputes are handled by Apple under Apple's applicable policies and local law.

12. Regional consumer rights

Nothing in these Terms limits any mandatory consumer rights that apply to you under the laws of your country or region of residence.

  • EEA, UK, Switzerland, and Turkey: If local consumer law grants you rights relating to digital content conformity, cancellation, remedies, unfair terms, or statutory guarantees, those rights continue to apply and these Terms should be read subject to them.
  • United States and Canada: Certain states, provinces, or territories may not allow some warranty disclaimers or liability limitations. Where that is the case, relevant parts of these Terms apply only to the maximum extent allowed by law.
  • Other regions: If your local law gives you non-waivable rights or protections, those rights remain in effect even if a different part of these Terms appears to say otherwise.

13. Changes to subscriptions and features

We may modify, improve, replace, suspend, or discontinue features, plan structures, app content, or service elements at any time, including to comply with legal, platform, or safety requirements. Apple may also change how subscriptions are presented or managed in your storefront.

14. Feedback and suggestions

If you send us suggestions, bug reports, feature ideas, or other feedback, you allow us to use that feedback without restriction or compensation, to the extent permitted by law. This helps us improve Zomroll for all users.

15. Intellectual property

Zomroll, including its software, visuals, branding, mascots, interface elements, text, graphics, and related materials, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license granted above, these Terms do not transfer any ownership rights to you.

16. Privacy and data use

Your use of Zomroll is also subject to our Privacy Policy, which explains how we handle information related to the app and support requests. Where these Terms and the Privacy Policy address the same topic, both should be read together.

17. Third-party services

Zomroll may rely on Apple frameworks, App Store services, or other third-party infrastructure to operate subscription validation, entitlement status, or device-level functionality. We are not responsible for third-party service outages, policy changes, billing actions, or platform limitations outside our control.

18. No medical or professional advice

Zomroll is designed for habit support and self-management. It does not provide medical, psychiatric, psychological, therapeutic, crisis, or legal advice. You should seek qualified professional help for health, mental health, or emergency concerns.

19. Disclaimer of warranties

To the fullest extent permitted by applicable law, Zomroll is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, perfect accuracy, specific behavioral outcomes, or error-free operation. Your use of the app is at your own risk.

20. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or device availability arising out of or related to your use of Zomroll. Nothing in these Terms limits rights that cannot be waived under applicable consumer law.

21. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, and costs that arise from your unlawful misuse of Zomroll, your violation of these Terms, or your infringement of another person's rights. This section does not apply where prohibited by mandatory consumer law.

22. Suspension and termination

We may suspend or terminate access to the app or related services if we reasonably believe you violated these Terms, misused the service, or created risk to users, systems, or compliance obligations. Termination does not automatically cancel your Apple subscription; subscription management remains subject to Apple's billing tools.

23. Severability and interpretation

If any part of these Terms is found unenforceable, the remaining sections will continue in effect to the fullest extent permitted by law. Headings are included for convenience only and do not limit the meaning of the underlying text.

24. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may update the date at the top of this page and, where appropriate, provide additional notice inside the app or on our website. Your continued use of Zomroll after an update means you accept the revised Terms.
